These Terms of Service ("Terms") govern your access to and use of ImgEnhancer.app ("ImgEnhancer", "we", "us", or "our"), including our website, AI image tools, accounts, credits, billing features, and related services.

By accessing or using ImgEnhancer.app, you agree to these Terms. If you do not agree, do not use the service.

Use of Services

ImgEnhancer.app provides AI image processing tools, including image enhancement, upscaling, restoration, background removal, and related image workflows. Features, tool availability, processing time, output quality, credit costs, and limits may vary by tool, plan, provider, account state, and system load.

The service is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted, error-free, secure, or that every image job will produce the result you expect.

Accounts

You are responsible for keeping your account secure and for all activity under your account. You must provide accurate information and must not create accounts or use visitor credits in a misleading, abusive, automated, or fraudulent way.

We may refuse, limit, suspend, or terminate access if we believe an account, visitor session, payment, image job, or usage pattern creates risk, violates these Terms, or harms the service or other users.

Credits, Plans, and Paid Access

Some features require credits, a subscription, a paid plan, or paid access. Credit costs and plan benefits are shown in the product or checkout flow and may vary by tool, setting, model, or output type.

Credits are a limited, non-cash service balance for using ImgEnhancer.app. Credits are not a bank account, stored value account, gift card, or currency. Unless required by law, credits are not transferable, redeemable for cash, or refundable.

Free credits, trial credits, promotional credits, login gifts, and similar grants may expire, be limited by country or region, and may be changed or withdrawn to prevent abuse or keep the service sustainable.

Billing and Subscriptions

We may process payments through third-party payment providers, including Stripe and PayPal. The available provider may vary by country, currency, checkout type, plan, and technical availability.

• Subscription plans renew automatically at the end of each billing cycle unless you cancel in advance.
• If you cancel a subscription, cancellation usually takes effect at the end of the current billing period unless the checkout page or payment provider states otherwise.
• One-time credit purchases, subscription charges, taxes, discounts, and billing cycles are shown during checkout.
• We may update pricing, credits, plan benefits, or payment providers prospectively for future billing periods or future purchases. Changes do not retroactively change charges already completed for an active billing period.
• Payment providers may apply their own terms, dispute rules, refund rules, and data processing practices.

Refunds

Unless a specific offer, checkout page, or applicable law says otherwise, fees are non-refundable by default after payment is completed or credits are delivered.

We may review refund requests case by case, especially where there is a duplicate payment, a billing error, a payment provider issue, or a service failure that prevents normal use. Refunds will be provided where required by applicable law or mandatory payment network rules.

User Content

You retain ownership of images, prompts, reference images, generated results, and other content you submit or create through the service, subject to any rights held by third parties.

You grant us a limited, worldwide, non-exclusive license to host, process, transmit, reproduce, modify, and display your content only as reasonably needed to provide the service, complete image jobs, maintain history, operate billing and credits, provide support, enforce safety rules, prevent abuse, comply with law, and improve service reliability.

You are responsible for making sure you have the rights and permissions needed to upload, process, generate, download, or share content through ImgEnhancer.app.

Acceptable Use Policy

You may not use ImgEnhancer.app to upload, generate, enhance, request, store, or share content that:

• Is sexually explicit, pornographic, nude, sexually suggestive, or otherwise NSFW.
• Exploits, sexualizes, or endangers minors in any way.
• Promotes violence, hate, harassment, self-harm, terrorism, illegal activity, or serious harm.
• Infringes another person's privacy, publicity, copyright, trademark, trade secret, or other rights.
• Is deceptive, fraudulent, impersonates someone else, or is intended to mislead.
• Attempts to bypass safety filters, moderation, rate limits, payment controls, or security protections.

We may use automated systems, provider-side checks, and manual review to detect prohibited content or abuse. If we believe you violate this policy, we may refuse processing, remove content, limit features, suspend credits, block payments, or terminate your account without prior notice where appropriate.

Prohibited Activities

You agree not to:

• Use the service in violation of any law, regulation, third-party right, or payment provider rule.
• Reverse engineer, scrape, overload, disrupt, or interfere with the service.
• Attempt to gain unauthorized access to accounts, systems, servers, storage, queues, APIs, or networks.
• Use bots, scripts, multiple accounts, fake identities, payment abuse, visitor credit abuse, or other methods to evade limits.
• Upload malware, harmful code, or content intended to attack, monitor, or harm others.
• Resell, sublicense, or commercially exploit the service in a way not authorized by us.

AI Outputs

AI-generated or AI-enhanced outputs may be inaccurate, incomplete, unexpected, or unsuitable for a particular use. You are responsible for reviewing outputs before using, publishing, or relying on them.

We do not promise that outputs are unique, free of third-party rights, legally usable in every context, or accepted by any marketplace, platform, authority, or customer.

Intellectual Property

ImgEnhancer.app, including the website, product design, software, workflows, text, graphics, logos, and service infrastructure, is owned by us or our licensors and is protected by copyright, trademark, and other laws.

These Terms do not give you ownership of ImgEnhancer.app or permission to use our branding except as allowed by law or with our written permission.

Third-Party Services

ImgEnhancer.app relies on third-party services for authentication, payments, storage, hosting, analytics, security checks, AI processing, and email. Third-party services may have their own terms, privacy policies, limits, and availability rules.

Limitation of Liability

To the fullest extent allowed by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, business interruption, or service unavailability arising from your use of or inability to use ImgEnhancer.app.

Where liability cannot be excluded, our liability will be limited to the amount you paid to ImgEnhancer.app for the service giving rise to the claim during the three months before the claim, or USD 100, whichever is greater, unless applicable law requires a higher amount.

Changes to Terms
